Terms and conditions of rental, delivery and return
1. Car use
The Hirer must take care of the car and must not use it:
1.
To carry more passengers than permitted on the vehicle registration.
2.
To transport passengers or goods for hire or reward.
3.
To tow or propel any other vehicle.
4.
To participate in any race or contest.
5.
While under the influence of alcohol or drugs.
6.
In contravention of traffic laws or regulations.
7.
By any person not authorised and named in the rental agreement.
8.
When a Class 3 cyclone warning is in effect.
Any breach of the above constitutes a breach of contract. The Hirer will be liable for all damages and losses incurred by Drive Mauritius / Magic Sun Tours LTD, including any amounts exceeding the deposit.
2. Car condition
The vehicle is delivered in perfect working order and clean condition.
It must be returned in the same condition; otherwise, cleaning costs will be charged to the Hirer.
All five tyres are in good condition without cuts. In case of damage (other than normal wear and tear), the Hirer agrees to replace them with tyres of the same size and type.
3. Equipment
Loss or damage to equipment specified in the rental agreement is not covered by the insurance and remains the responsibility of the Hirer.
4. Fuel and oil
Fuel costs are the responsibility of the Hirer.
The Hirer must regularly check oil and coolant levels and provide receipts for any refills made during the rental period.
5. Maintenance and repairs
Repairs due to abnormal wear and tear caused by negligence will be charged to the Hirer and carried out exclusively by Drive Mauritius / Magic Sun Tours LTD.
If the vehicle is immobilised, repairs may only be carried out with prior authorisation from the company and in accordance with its instructions.
The company is not liable for injuries or damages resulting from manufacturing defects or previous repairs.
6. Insurance
The Hirer’s liability is limited to an excess of MUR 30,000 (if more than one driver) per incident.
This amount is payable upon delivery and refundable upon return, minus repair costs if applicable.
The excess can be reduced to MUR 6,500 / 10,000 by purchasing a Damage Waiver at MUR 150 per day.
The Hirer must (otherwise insurance coverage will be voided):
1.
Report any accident, theft, or fire to Drive Mauritius / Magic Sun Tours LTD and the police within 4 hours of the event.
2.
Provide details of the circumstances, date, time, and location of the incident.
3.
Provide the name, address, vehicle make, registration number, and insurance details of any third parties involved.
Note: Personal belongings in the vehicle are not covered by insurance.
7. Jurisdiction
All disputes between the Hirer and Drive Mauritius / Magic Sun Tours LTD fall under the exclusive jurisdiction of the courts of Mauritius.
Legal expenses are borne by the Hirer.
A 10% attorney’s commission on any amounts recovered through legal action will also be charged to the Hirer.
